<p>1. Данная ситуация регулируется нормами Уголовного кодекса РФ и Федеральным законом от 21.11.2011 N 323-ФЗ (ред. от 25.11.2013) «Об основах охраны здоровья граждан в Российской Федерации».</p>
<p>2.1 Закон «Об основах охраны здоровья граждан в Российской Федерации» прямо говорит о том, что «Медицинские организации, медицинские работники и фармацевтические работники несут ответственность в соответствии с законодательством Российской Федерации за нарушение прав в сфере охраны здоровья, причинение вреда жизни и (или) здоровью при оказании гражданам медицинской помощи».</p>
<p>2.2 Родители вправе требовать привлечения медицинских работников данного учреждения к привлечению к уголовной ответственности по следующим статьям Уголовного кодекса 109 («Причинение смерти по неосторожности»), 293 («Халатность») и 236 («Нарушение санитарно-эпидемиологических правил, повлекшее по неосторожности массовое заболевание или отравление людей»).</p><h2>Вопрос</h2>
